China Job Applicant Privacy Notice

AFH Trading (Shanghai) Co., Ltd, 爱芙趣商贸(上海)有限公司 and AFH International Trading (Shanghai) Co., Ltd, 爱芙趣国际贸易(上海)有限公司 (collectively, “A&F,” “we,” “our,” “us”) respect your concerns about privacy. This Privacy Notice describes the types of personal information we collect in connection with our recruitment and hiring activities, including through our career website, how we may use the information, and with whom we may share it. This Privacy Notice also describes the choices available regarding our use of the information, the measures we take to protect the information, and how you can contact us about our privacy practices.

The entity responsible for the processing of your personal information as described in this Privacy Notice is the A&F entity for which you apply or are recruited for a job. Any reference to “applicant,” “you,” or “your” means you, the job applicant or candidate.

Information We Collect

The types of personal information we collect include:

  • Contact information, such as name, postal and email address, and telephone number;
  • Personal characteristics, such as date and place of birth and gender;
  • Professional details and employment data, such as resume/CV, employment history, performance-related information (e.g., evaluations, training records, and test scores), talent management information (e.g., educational history and details, and professional qualifications), work authorization status, and information about references;
  • Video footage for candidate screening;
  • Travel-related information, such as frequent flyer number and travel preferences and;
  • Other personal information contained in content you submit to us (e.g., letters, photographs). 

Please note that if you do not provide us with certain required personal information, A&F may not be able to consider your application.

Using Information We Collect

A&F uses the personal information it collects about you to manage the recruitment process and career opportunities at A&F. In particular, we use the personal information we obtain about you for the following purposes:

  • Reviewing and evaluating candidacies for employment;
  • Administering our online careers website;
  • Verifying references and employment history;
  • Making travel arrangements and expenses;
  • Managing the new employee onboarding process;
  • Operating, managing and safeguarding our facilities and other properties,
  • Monitoring, detecting, preventing and investigating fraud, misconduct and ethical violations; 
  • Complying with requests from government or other public authorities, responding to legal process, and pursuing legal rights and remedies; and
  • Complying with legal requirements (including reporting obligations), relevant industry standards and our internal policies.

Justification for Processing

Our processing of your personal data is necessary for A&F’s legitimate interests of recruiting employees. The application process requires you to provide your personal data, except in limited instances where A&F indicates that certain information is voluntary. If you refuse to share certain required personal information with A&F, we may not be able to consider your application or hire you.

Information We Share with Third Parties

Your personal information will be accessible to those individuals within A&F with a legitimate need to access and process such information to perform their job responsibilities. We also share your personal information with A&F affiliates for the purposes described in this Privacy Notice. To the extent required by law, A&F will obtain your consent to share your personal information with third parties.

In accordance with applicable law, we may disclose information about you (1) if we are required to do so by law or legal process; (2) in response to requests by government agencies, such as law enforcement authorities; (3) to establish, exercise or defend our legal rights; (4) when we believe disclosure is necessary or appropriate to prevent physical or other harm, fraudulent activity or financial loss; (5) in connection with an investigation of suspected or actual illegal activity; or (6) otherwise with your consent.

We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution or liquidation).

Data Transfers

We may transfer the personal information we collect about you to recipients outside of Mainland China, such as Hong Kong and Japan. Those countries may not have the same data protection laws as those in Mainland China. When we transfer your personal information to recipients in other countries, we will comply with applicable legal requirements regarding the transfer of personal information outside of China.

Retention of Personal Information

We will keep your personal information for the time period necessary to achieve the purposes outlined in this Privacy Notice, plus a reasonable period to comply with the applicable statute of limitations or if otherwise required under applicable law.

Your Rights and Choices

To the extent provided by applicable law, you may have the right to: (1) request access to the personal information we maintain about you; (2) request that we rectify personal information about you that is inaccurate; (3) request that we erase personal information about you under certain circumstances provided by applicable law; (4) request the restriction of our processing of your personal information; (5) object at any time to the processing of your personal information; and (6) request an explanation of an automated decision that has a material impact on your rights and request not to be subject to solely automated decision-making.

Where you have consented to the processing of your personal information, you have the right to withdraw your prior consent at any time. Subject to applicable law, you also have the right to request that your personal information be transmitted to another company where it is technically feasible.

You may lodge a complaint with the relevant personal information protection authorities if you are not satisfied with our response to your request.

How We Protect Personal Information

We maintain administrative, technical and physical safeguards designed to protect personal information against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

Updates to Privacy Notice

This Privacy Notice may be updated periodically to reflect changes in our privacy practices. A&F will post a notice on its career website to notify you of significant changes and indicate at the top of the Privacy Notice when it was most recently updated.
